Because we are a Brazilian immigration service, your data is processed under Brazil's Lei Geral de Proteção de Dados (LGPD, Lei 13.709/2018). If you are in the United Kingdom or the European Economic Area, the UK GDPR or the EU GDPR also applies to you, and this policy is written to satisfy both. Immigration work involves unusually sensitive paperwork: passports, income evidence, criminal background checks. We have tried to be specific about what happens to each of those rather than describing them in general terms. ### Who Controls Your Data The controller of your personal data, meaning the party that decides why and how it is processed, is: - •**Legal entity:** {{LEGAL\_ENTITY\_NAME}}, trading as GetBrazilVisa - •**Registered address:** {{REGISTERED\_ADDRESS}} - •**Company registration:** {{COMPANY\_REGISTRATION\_NUMBER}} Legal work on your application is carried out by Camila Araujo Mota, an immigration lawyer licensed by the Brazilian Bar Association (OAB/CE 50.065). Communications with her about your case are also covered by professional confidentiality obligations, which sit alongside this policy rather than replacing it. **Data Protection Officer (Encarregado).** Under Article 41 of the LGPD we have appointed an encarregado to handle data protection questions and requests: {{DPO\_NAME}}, reachable at [privacy@getbrazilvisa.com](mailto:privacy@getbrazilvisa.com). ### Information We Collect We collect the following types of information: - •**Enquiry and eligibility data:** the answers you give in our eligibility quiz or intake form, including your name, email, WhatsApp number, nationality, location, income range and work arrangement. You do not need an account for us to receive this - •**Account information:** email, name and phone number if you create an account in our client portal - •**Visa application data:** the personal details required by Brazilian immigration authorities to file your application - •**Documents:** passports, bank statements, employment and contract letters, criminal background checks, and other documents you upload or send us - •**Correspondence:** messages you exchange with us by email, through the portal, or on WhatsApp, and conversations with our AI visa assistant - •**Payment information:** processed by Stripe. We receive confirmation that a payment succeeded, and we never see or store your card details - •**Usage data:** pages viewed, approximate location derived from IP address, device and browser type, and how you arrived at the site. This is collected only if you accept analytics cookies **A note on criminal background checks.** Brazilian immigration law requires a criminal record certificate for most residence applications. Data about criminal convictions receives heightened protection under both the LGPD and the GDPR. We collect it only because it is legally required to file your application, we share it only with the Brazilian authorities who require it, and we delete it on the retention schedule below. ### Why We Are Allowed To Process It Both the LGPD (Article 7) and the GDPR (Article 6) require a specific legal basis for each purpose. Ours are: - •**To assess your eligibility and answer your enquiry:** your consent, and steps taken at your request before entering a contract - •**To prepare and file your visa application:** performance of our contract with you - •**To handle your documents, including criminal record certificates:** performance of the contract, and compliance with the legal and regulatory obligations that govern an immigration filing - •**To keep records after your case closes:** compliance with our legal obligations, and our legitimate interest in defending against later claims - •**Analytics and advertising measurement:** your consent, given through the cookie banner, and withdrawable at any time Where we rely on consent, you can withdraw it at any time without affecting work already lawfully carried out on your case. ### How AI Processes Your Documents When you upload documents, our AI analyzes them to: - •Verify document type and completeness - •Extract key information (names, dates, amounts) - •Check for common issues that could cause visa rejection **Privacy Safeguards:** AI analysis is performed in real-time. We store the extracted data and validation results, but AI model responses are not retained beyond the scanning session. Your original documents are encrypted and stored securely. **No automated decisions are made about you.** The AI flags possible problems in a document. Whether your application proceeds, and how it is filed, is always decided by Camila. Both the LGPD (Article 20) and the GDPR (Article 22) give you the right not to be subject to a decision based solely on automated processing, and you can ask us to review any AI output that affected your file. **Full Service customers** can opt for 100% human-only document review if preferred. Simply toggle the "Skip AI scanning" option in the Documents section. ### Data Storage & Security Your data is protected with industry-standard security measures: - •**Encryption:** All data is encrypted in transit (TLS 1.3) and at rest (AES-256) - •**Secure Storage:** Documents stored in isolated, access-controlled cloud storage - •**Access Controls:** Only authorized team members can access your application data - •**No Marketing Sharing:** We never sell or share your data for marketing purposes If a security incident affects your personal data and creates a risk to you, we will notify you and the Brazilian data protection authority (ANPD), and where the GDPR applies, the relevant supervisory authority, within the timeframes those laws require. ### Who Else Handles Your Data We use the following providers to operate the service. Each acts as a processor on our instructions, under the data processing terms that form part of their service agreements: - •**Google (Forms and Sheets):** receives your eligibility quiz and intake form answers, which is where your enquiry is recorded - •**Supabase:** database and file storage for accounts, application data and uploaded documents - •**Google Gemini:** AI document analysis (processes data, does not retain it beyond the session) - •**Stripe:** payment processing - •**Resend:** transactional email - •**Meta Platforms (WhatsApp):** processes your phone number and message contents when you contact us there - •**Google Analytics, DataFast and Ahrefs Analytics:** website usage measurement. These run only if you accept analytics cookies - •**Google Ads:** advertising measurement, recording whether a visit that began with one of our ads led to a completed eligibility check. Not used for ad profiles or retargeting - •**Cloudflare:** content delivery, security and hosting infrastructure - •**Google Fonts and YouTube:** embedded fonts and videos. Loading these reveals your IP address to Google. YouTube embeds use the privacy-enhanced mode where available We also share what is strictly necessary with the Brazilian authorities who decide your application, principally the Ministry of Justice and Public Security, the Federal Police, and where relevant a Brazilian consulate. That sharing is the point of the service. **Contacting us on WhatsApp.** If you message us on WhatsApp, or give us your number and ask us to reach you there, your phone number and the contents of that conversation are processed by Meta Platforms under its own terms and privacy policy, in addition to this one. We use WhatsApp only to correspond with you about your own case. You can ask us to stop contacting you on WhatsApp at any time, simply by saying so in the conversation, and we will honour that request without affecting your case. We do not send marketing or promotional messages on WhatsApp. ### Sending Data Outside Brazil Several of the providers above store or process data outside Brazil, principally in the United States and the European Union. Article 33 of the LGPD, and Chapter V of the GDPR, permit this only on specific grounds. - •**Standard contractual clauses:** we rely on the clauses included in our providers' data processing terms, which commit them to an equivalent level of protection - •**Necessity for your contract:** where a transfer is required to deliver the service you asked us for - •**Your consent:** for analytics, which you can decline without any effect on your application You can ask us for details of the safeguards applying to any specific transfer at [privacy@getbrazilvisa.com](mailto:privacy@getbrazilvisa.com). ### Cookies and Analytics We use two categories of cookie and similar technology: - •**Strictly necessary:** keep you signed in, remember your language, and keep the site secure. These do not require consent and cannot be turned off - •**Analytics and measurement:** Google Analytics, DataFast and Ahrefs Analytics, which tell us which pages are useful and where people get stuck. These run only after you accept them - •**Advertising measurement:** the Google Ads tag, which records whether a visit that started from one of our ads led to a completed eligibility check. It is not used for ad profiles or retargeting. In the EEA, the United Kingdom and Switzerland it sets its cookie only after you accept it in the cookie banner You choose when you first arrive, and you can change your mind at any time through the cookie settings link in the footer. Declining analytics has no effect on your application or the service you receive. ### Your Rights & Data Control Article 18 of the LGPD, and the equivalent GDPR provisions, give you the following rights over your data: - •**Confirmation and access:** to be told whether we hold data about you, and to receive a copy - •**Correction:** to have incomplete or inaccurate data fixed - •**Deletion:** to have data deleted, including anything we hold on the basis of your consent - •**Anonymisation or blocking:** where data is unnecessary, excessive, or processed in a way that does not comply with the law - •**Portability:** to receive your data in a machine-readable format, or have it sent to another provider - •**Information about sharing:** to be told which public and private bodies we have shared your data with - •**Objection, and withdrawal of consent:** to object to processing, or withdraw consent you previously gave - •**Human review:** to ask that a decision made with automated assistance be reviewed by a person **How to exercise them.** If you have a portal account, your account settings are managed in the client portal at [app.getbrazilvisa.com](https://app.getbrazilvisa.com). If you do not have an account, and most people who contact us do not, email [privacy@getbrazilvisa.com](mailto:privacy@getbrazilvisa.com) and we will action it. We respond within 15 days, and we do not charge for this. One limit worth stating plainly: while your application is live with the Brazilian authorities, some data cannot be deleted on request, because we are required to retain it to conduct the filing. We will tell you exactly what falls into that category and delete the rest. If you are unhappy with how we have handled a request, you can complain to the Brazilian National Data Protection Authority (ANPD) at [gov.br/anpd](https://www.gov.br/anpd). If the GDPR applies to you, you can complain to your national supervisory authority instead. ### Data Retention We keep data only as long as we have a reason to: - •**Enquiries that do not become cases:** deleted after 12 months, unless you ask us sooner - •**Active accounts:** retained while your account is active - •**Completed applications:** retained for 2 years for support purposes, then auto-deleted - •**Criminal record certificates and passport copies:** deleted once your application has been decided and any appeal window has closed, unless you ask us to keep them for a renewal - •**Inactive accounts:** after 2 years of inactivity, you receive a notice before deletion - •**Records we must keep by law:** billing and professional records retained for the period Brazilian law requires, then deleted - •**Immediate deletion:** request it at any time via Profile Settings or by email ### Children and Dependants Our service is not directed at children, and we do not knowingly collect data from a child who has approached us directly. Family applications are different. If you include a child as a dependant, you will give us their data as their parent or legal guardian, and Article 14 of the LGPD requires that we process it in their best interest.
