# From VITEM XIV to Permanent Residency: Brazil's 2-Year Path Explained

The roadmap digital nomads use to trade their temporary visa for a permanent one, and how that becomes a path to Brazilian citizenship.

After two continuous years on the VITEM XIV (year 1 + renewal for year 2), digital nomads can apply for Brazilian permanent residency under Resolução Normativa CNIg nº 31. Permanent status removes renewal obligations, removes the foreign-source income restriction, and opens Brazilian labour markets. From permanent residency, naturalization is possible after four years (if married to a Brazilian citizen or parent of a Brazilian child) or fifteen years (general path) under the Migration Law (Lei nº 13.445/2017), Articles 65–70.

## Legal Basis: Resolução Normativa CNIg nº 31

Resolução Normativa CNIg nº 31 governs the conversion of temporary residence authorizations into permanent residency. It covers several temporary visa categories (including VITEM XIV) where the applicant has completed a qualifying period of lawful temporary residence in Brazil.

Official Rule

RN 31 requires: (1) continuous temporary residence on an eligible category, (2) compliance with reporting obligations (CRNM kept current, no overstays), (3) no criminal record in Brazil, (4) proof of means of subsistence, and (5) submission before the current temporary CRNM expires. For VITEM XIV holders, the standard qualifying period is two years held as a temporary resident.

## Tax Residency Implications

Permanent residency does not automatically make you a Brazilian tax resident. The 184-day rule still governs. You become a Brazilian tax resident the moment your physical presence in Brazil reaches 184 days in any rolling 12-month window. Most permanent residents who live full-time in Brazil fall inside this threshold.

Official Rule

Under the 2026 IRPF reform, up to R$5,000 per month (R$60,000 per year) is fully exempt from personal income tax. Income above that is taxed at progressive rates up to 27.5%. Brazil maintains tax treaties with many jurisdictions (including Canada, the UK, France, Germany, Italy) that allocate taxing rights and prevent double taxation. The US–Brazil relationship is governed by unilateral credits rather than a treaty.

Practical Interpretation

Engage a cross-border tax advisor before your 184th day. Many permanent residents structure their affairs so that the bulk of foreign-source income falls under treaty protection or the R$60,000 exemption, while Brazilian-source income is taxed normally. The 2026 reform improves the arithmetic significantly for digital-nomad-style income profiles.

## Citizenship Paths After Permanent Residency

Brazilian citizenship (naturalization) is governed by Lei nº 13.445/2017, Articles 65–70. Two principal paths apply to former VITEM XIV holders:

Brazil allows dual citizenship, but check your home country

Brazil does not require renunciation of previous citizenship. Some countries do, notably Japan, India (overseas citizen alternatives exist), and Austria. US, Canadian, UK, and most EU citizens retain their original citizenship upon naturalizing as Brazilian.

## Documents for the Permanent Residency Application

-   Current valid passport and all CRNM cards held during the 2-year VITEM XIV period
-   Completed RN 31 application form (Polícia Federal)
-   Proof of clean criminal record in Brazil (Atestado de Antecedentes Criminais: federal and state)
-   Updated background check from country of citizenship, apostilled and sworn-translated (if required by the reviewing officer)
-   Proof of means of subsistence: bank statements, employment records, business registration, or continued foreign income
-   Proof of Brazilian address (comprovante de residência: utility bill, rental contract, condo statement)
-   CPF number (obtained during VITEM XIV period if not before)
-   GRU payment receipt for RN 31 processing fee

## Common Mistakes That Cost Permanent Residency

-   Missing the CRNM renewal before year 2

    If your year-1 CRNM expires without a timely renewal filing, your temporary status lapses and the 2-year clock resets, or you must leave Brazil entirely. File renewal within the 90 days before year-1 expiry.

-   Overstaying the 90-day DOU publication window

    After your initial VITEM XIV approval, you have 90 days from DOU publication to register at the Polícia Federal and obtain your CRNM. Missing this window invalidates the approval and you lose the base you need to later file for permanent residency.

-   Long absences from Brazil during the 2-year period

    While the VITEM XIV does not mandate a minimum number of days in Brazil, filing for RN 31 permanent residency is much smoother when you can demonstrate substantive presence. Extended trips abroad (>6 months) invite scrutiny.

-   Applying too early or too late

    Apply in the final 90 days of your year-2 CRNM: not before you complete 2 years, and not after the card expires. Filing inside this window gives Polícia Federal clear authority to process the conversion.

-   Ignoring dependent renewals

    Each family dependent must have a current CRNM to convert to permanent residency. A spouse or child whose dependent card expires without renewal cannot ride along on the primary applicant's RN 31 filing automatically.
